Minor car accident (not at fault) - should I go to my insurance or small claims court?

I was wondering if anyone could give me some advice. Last week I was involved in a minor car accident. I was at a stop light and the car behind me decided they could not wait and they tried to get by my car to make a left turn. They did not have enough room and scraped against my car with theirs. No one was hurt and no police were called. We pulled over and I got their name, phone number and address. They did not give me their insurance information and said they'd like to settle outside insurance because there are only scratches. I know it was stupid but I said okay. Also I do not have the license plate number of the car. I thought I wrote it down but I did not (I understand this is a big mistake on my behalf). We made contact over phone throughout the week and discussed repairs but suddenly they stopped answering my calls. I believe they are avoiding me. Now I am at a loss of what to do. Should I take this issue up with my insurance (at the risk of raising my premiums) or should I take this to small claims court? In either case I do not have the car's license plate so if it isn't their car will that be insufficient evidence to prove they are at fault (my word against theirs)? Some friends go through such a bull5hit time - one friend was charged $500 to borrow a blanket in the waiting room at a health care clinic and all she had to do was make a call and complain to cancel the full amount. We were baffled So.. they get paid $500 for lending a blanket? They take the $500 away if we complain? It's like complaining at a restaurant LOL!!! I maybe ignorant, but it makes me so upset to see people without insurance having such a hard time affording health care. Health care and insurance makes me feel like I'm giving into a manipulative scam - like buying a $120 clothing that only costs $5 to make. I have car insurance on my 2010 ford focus. When i signed up with them they never asked me about my title. it does have a salvage title but they never asked me if it had one or not. I have been insured with them for approximately almost 2 years with A+ plus driving history. I had some small damage that has been done to my car by a citizen of whom I have no idea but that scratch the sides of my vehicle with I guess the key or some type of odd objects. I put a claim in to have my car to be looked at and to have them to pay me the value of what my vehicle was worth. I've been paying full coverage since the day I started with them. when I put the claim in is when they discovered that it had a salvage title. Theey did send me a check for the amount of damages. this is an out of state check so its not able to be cash immediately. I have two questions I would like to ask. 1. are they able to put a stop on this check. 2. the retention department has been calling me what is the retention
